SFVBA Program June 24, 2016 – Settling with the Trustee

Dear All:

We try real hard to have practical programs where you can walk out the door with nuggets and gems to use in your practices. We leave the ivory tower stuff (and the high admission fees) to the bankruptcy groups on the Westside and downtown.

We have a program next Friday, June 24, 2016, at 12 noon at the bar office which can really improve the way you handle your chapter 7 and chapter 13 cases and help you when your client is in a dispute or a lawsuit with a panel trustee. We have a panel of trustee and trustee attorneys who will speak about what trustees are doing now, in these times of low filings, to create value from what may have been no-asset cases just a couple of years ago.

The panel will talk about at various assets that trustees are looking at more and more. These include insurance policies, rights of a debtor to bring a suit, property held in the name of a partner or a partnership, property of non-debtor spouses and the sale of property held by a debtor and a non-debtor. Trustees these days are taking 2nd and 3rd looks at trusts, including irrevocable trusts, to try to reach assets in trusts. Given the low number of filings trustees have to look for any intellectual property to try to create value.

If you represent creditors, debtors or perhaps third parties who are caught up in a trustee’s investigation and administration, this program is for you. If you represent trustees this program is for you s well. This is the 3rd time this panel will speak on settling with the trustee and each time the panel has covered new ground and answered many, many questions.

The cost is ½ and less of what certain bar associations over the hill charge for the same program. Not only that, parking is free (rear of the building).
