If you have not seen it already, the new court website is really nice.
The Supreme Court has granted cert in the 11th Circuit case of Bullock v. BankChampaign, N.A. You can get all the briefs from the link. This is a section 523(a)(4) action. The debtor/defendant was the trustee of a trust. He caused the trust to loan money to his mother and himself. They used the funds to buy real property. They later paid back the loans with interest but the benys of the trust want the “profits” earned by the debtor in the form of increase in value of the real property that were purchased with the money. The state court proceeding awarded the profits to the benys plus attorneys fees. Given there is no “loss of trust property,” is there a defalcation?
Oral argument will probably be in March or April, 2013.

Judge Laura Taylor in San Diego has been appointed to the 9th Circuit Bankruptcy Appelate Panel (“BAP”) to succeed Judge Eileen Hollowell. The BAP judges term is seven years. The announcement is here. There are only six judges on the BAP so it is quite an honor and quite a big job.

I attended the Bar Advisory Committee meeting today downtown. Kathy Campbell told us that her office is laying off 24 “temporary” clerks. The term temporary is used only because they are not permanent, that is they are basic “contract” employees. Kathy commented that the clerks have experience obviously with bankruptcy forms and bankruptcy cases and the process so if anyone is looking for a clerk with some experience, call Kathy Campbell and she will see if she can match someone up with your particular needs. Kathy invited the call. Call the clerk’s office downtown and ask for her.
