Judge Scott Clarkson Highlights JFK Accomplishments

Something rather remarkable happened a couple of Friday’s ago in Bankruptcy Courtroom 5C of the Ronald Reagan Federal Courthouse in Santa Ana — but almost passed unnoticed.  At noon on Friday, November 22, Judge Scott Clarkson held a special session of court commemorating the 50th anniversary of the passing of President John Fitzgerald Kennedy.  The session was attended by about sixty five persons, mainly employees of the Bankruptcy, District and Magistrate courts in Santa Ana.  Also present were seven District Court, Magistrate Court and Bankruptcy Court Judges.

During his comments, Judge Clarkson highlighted many of Kennedy’s path-making accomplishments, while emphasizing the brevity of Kennedy’s term in office (only 34 months).  Judge Clarkson commented that Kennedy was the first Catholic president and a vigorous champion civil and equal rights.  Kennedy supported the passage of the Equal Pay Act of 1963, and his agenda prompted President Lyndon Johnson, Kennedy’s successor, to carry forward this legacy by managing the enactment of the Civil Rights Act of 1964.  In a sobering aside, Judge Clarkson noted just how close the world was to nuclear war in 1962 during the Cuban Missile Crisis, and explained how Kennedy’s efforts were instrumental in averting such a major catastrophe.  After Judge Clarkson’s opening comments, the court lights dimmed and the audience was treated to a full screening of President Kennedy’s January 20, 1961 inaugural address.

CM/ECF Docket Event Updates Effective December 1, 2013

ATTENTION ECF USERS:

Attached is a summary of CM/ECF docket event changes that will take effect on December 1, 2013, to coincide with the amendments to Bankruptcy Rules and Official Bankruptcy Forms, and changes to the Bankruptcy Miscellaneous Fee Schedule, which will also take effect on December 1, 2013.

New Docket Event for Transcript Order Form

ATTENTION ECF USERS:

Effective November 25, 2013, when requesting a transcript of a hearing, file the Transcript Order Form in CM/ECF using new docket event, Transcript Order Form (Public Request).

Revised Transcript Ordering Instructions and Form (rev. date is November 25, 2013) are located at http://www.cacb.uscourts.gov/track-transcript-status

Upon receipt of the Transcript Order Form through CM/ECF, the Clerk’s Office will prepare and transmit the Court’s records of the hearing to the Transcriber. The Clerk’s Office will then docket a Transcript Records Transmittal and relate it to the Transcript Order Form. More information regarding these docket events and tracking the status of a transcript is located on the Court’s website at http://www.cacb.uscourts.gov/track-transcript-status

Judge Zurzolo and Relief from Stay Motions

Dear Colleagues!

Judge Zurolo has announced today that any motions that contain a POS that does not conform with the Local Rules, i.e., stating the capacity of each party served, the Court will now continue the hearing in order to receive an Amended POS. In the past this Court would simply conditionally grant the motion subject to the movant submitting an amended POS. The Court stated that since he has been enforcing this Local Rule for over 2 years, and this procedure (courtesy) is now over.

To my creditor colleagues and my debtor colleagues (filing Responses and their own various motions) a big FYI!

Availability of highly trained staff for hire

As many of you are aware, due to the decline in bankruptcy filings and the earlier mandated budget cuts, our Bankruptcy Court has had to incur recent significant staff layoffs and early retirements. 18 of our fellow bankruptcy staff throughout the Central District have been laid off effective Friday, October 4th, with many others taking early (often to their overall career plans — premature) retirement. These staffers are highly trained in their respective bankruptcy fields.

Proudly, our Court has set up a set separate department in Los Angeles to serve as a clearinghouse for ALL the divisions for people looking for trained bankruptcy staff to hire. Filing Adversary Complaints on Closed Cases

Attention ECF Users:

Effective on Monday, September 30, 2013, the CM/ECF system will be modified to permit the filing of an adversary complaint to determine whether a particular debt is exempted from discharge without reopening the main bankruptcy case or paying a filing fee.

New Electronic Summons! (Effective September 23, 2013)

The Court will soon be implementing an automated process for issuing a completed Summons (or Alias Summons)and Notice of Status Conference Summons) in an adversary proceeding.

Under this new automated process, plaintiffs will no longer need to lodge a proposed form of Summons in order to have a Summons or an Alias Summons issued in an adversary proceeding as currently required by Local Bankruptcy Rule 7004-1(a).  The Court will prepare the required Summons or Alias Summons.  Plaintiffs who are registered CM/ECF users will receive an issued Summons or Alias Summons electronically (by Notice of Electronic Filing — NEF).  Plaintiffs who are not registered CM/ECF users will receive a printed copy of the issued Summons or Alias Summons by U.S.mail.  Local Bankruptcy Rule 7004-1(a) will be revised in the future to accommodate these changes.

All plaintiffs will continue to be responsible for serving the completed Summons on all defendants, as required by Local Bankruptcy Rule 7004-1(b) and FRBP 7004.
