Debtor Electronic Bankruptcy Noticing (“DeBN”)

The bankruptcy court has recently initiated a pilot program called the Debtor Electronic Bankruptcy Noticing (“DeBN”). DeBN gives debtors the opportunity to request receiving court orders and court-generated notices via email rather than by U.S. Mail to their mailing address.
The court began testing DeBN on February 24, 2014, and the court will conclude the pilot program on May, 2014. The ability for the debtor to receive court orders and court-generated notices by email has several advantages:

-It’s fast – Debtors receive court orders and court-generated notices quickly, often on the same day they are filed.
-It’s convenient – Debtors can read and/or save the court orders and notices on their mobile device, iPad, and home computer.
-It’s free – Court orders and court-generated notices can be viewed an unlimited number of times on the debtor’s mobile device or home computer at no charge.
-It’s green – less paper clutter.

Attached  hereto is additional information about how both represented and pro se debtors can request having court orders and court-generated notices sent to them via email from the court.

The judges have graciously agreed to discuss the transition and the coming procedural changes. Please join the Santa Barbara County Bar Association for a lunch time MCLE to hear what is in store for the future.

Arkison (In re Bellingham Insurance Agency, Inc.) case (see Insolvency Law e-Bulletin published on January 3, 2014 for an in-depth summary of the case).  The United States Supreme Court heard oral arguments in the case this week, onJanuary 14, 2014.

Law Firm Sanctioned $5,000 for Filing Baseless Credit Card Complaint in Santa Ana

Judge Scott Clarkson has sanctioned the firm of Weinstein, Pinson & Riley $5,000 for filing a non-dischargeability complaint for a credit card company.  The firm did minimal if any investigation before filing the complaint.  A great article on the case can be found here.

Magnificently restored, the former Tower Room is once again the jewel in the crown of Los Angeles City Hall. The room is atop the City Hall Tower, which rises 27 floors above Spring and Main Streets, and for decades was the tallest structure in Los Angeles. The restoration of City Hall following the Northridge Earthquake included the ornate ceiling decorations, art deco lighting fixtures, and huge windows looking out to an observation deck with 360 degree views over the city. Following its restoration, the room has been named in honor of Mayor Tom Bradley.
